====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 18-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case for the offence registered under Sections 147, 149, 447, 341, 323, 307, 354(B) and 379 of the IPC.
The prosecution story, in brief, is that the petitioner alongwith co-accused persons armed with weapon came to the house of the informant and began teasing, molesting her female members. On cry of the informant, her brothers-in-law Upendra Mandal and Umesh Mandal came and protested, whereupon the accused persons assaulted on the head of Umesh Mandal with Iron rod and co-accused Lachman Sah gave Lathi blow to him. Co-accused Upendra Sah assaulted Upendra Mandal with

When he fell down, co-accused Mukesh Sah assaulted him with rod and co-accused Mahadev Sah caught hold the informant and co-accused Sanjeev Sah snatched her golden chain. On shouting, when her sister-in-law came, they assaulted her in courtyard and co-accused Jaikrishan Sah snatched Mobile and golden chain and co-accused Chandan Sah gave leg blow on her stomach and snatched away ear-rings. Petitioner and other co-accused persons went away holding out threat to kill her. It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 02.06.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case.
There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is case and counter case between the parties. Free fight is alleged to have taken place between the parties. Injury on the accused side has not been explained by the prosecution. The prosecution has not come with clean hands. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing
Patna High Court CR. MISC. No.58583 of 2019(2) dt.18-09-2019 3/3 bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- Ist, Supaul, in connection with Triveniganj P.S. Case No. 99 of 2019.
