This is an application for anticipatory bail for the offence punishable under sections 498, 419, 420, 467, 468 and 120 (B) of the I.P.C. It is alleged that on inspection only 45 students were found present though attendance was of 62 students and in the school there are 100 students enrolled. Thus, in five months amount of Rs. 2,47,500/- has been misappropriated showing the number of students more than the actual. Further cash book and other documents were not produced for verification. Submission is that as a matter of fact on that date 62 students were present and as the petitioner does not fulfill the illegal demand of the informant she has been implicated, to which the learned A.P.P. opposes. Be that as it may, considering that admittedly in the attendance there were 62 students and only on the basis of one day inspection such conclusion appears not reasonable or probable and as such the petitioner in
Patna High Court Cr.Misc. No.29659 of 2014 (2) dt.13-01-2015 2/2 case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Munger in Kharagpur P.S. Case No. 26 of 2014/G.R. No. 241 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
