Apprehending his arrest in Rani Talab P.S. Case No. 96 of 2016 registered under Sections 341, 323, 504, 379, 307 and 34 of the Indian Penal Code, the present application is filed for grant of anticipatory bail.
On going through the F.I.R., it is apparent that the petitioner was responsible for inflicting injury on the head of the Sudeshwar Yadav which caused injury grievous in nature. Counsel for the petitioner submits that due to enmity, he has been falsely implicated in this case. He further submits that there is no injury report available with the case diary.
The State opposed the prayer and submits that specific
Patna High Court Cr.Misc. No.24908 of 2017 (2) dt.13-07-2017 2/2 allegation is attributed to the petitioner.
Considering the facts and circumstances of the case, I am not inclined to direct release of the petitioner on anticipatory bail. Prayer is rejected. Petitioner shall surrender and prayer for bail which shall be considered on its own merit in accordance with law.
