JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-04-2019 This is an application for grant of anticipatory bail in connection with K. Hat P.S. Case No. 214 of 2018, disclosing offences under Sections 406, 420, 120(B) of the Indian Penal Code.

Allegation as per written report is that one Satya Narayan Yadav approached the informant for sell of a piece of land and told him that Yashwardhan Singh will make the agreement and on that the informant has given advance to Yashwardhan Singh and thereafter he told that Yashwardhan Singh could not pay the amount in time due to that agreement be considered as cancelled and thereafter he has taken Rs.23,87,000/-, but thereafter refused to register the sale-deed and it is alleged that in presence of the petitioner and others, the money was given to Satya Narayan Yadav.

No.6901 of 2019(3) dt.03-04-2019 2/2 Submission of learned counsel for the petitioner is that even according to the F.I.R. the allegation is against one Satya Narayan Yadav and Yashwardhan Singh of taking money and not executing the sale-deed and the petitioner has been made accused in this case only because he is the son of Satya Narayan Yadav.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea, in connection with K. Hat P.S. Case No. 214 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
