JUSTICE PURNENDU SINGH ORAL ORDER 19-09-2025 Heard Mr. Shailendra Kumar Singh, learned senior counsel along with Mr. Sanjay Kumar, learned counsel appearing on behalf of the petitioners; Mr. Ram Sevak Choudhary, learned APP for the State and Mr. Manish Kumar Singh, learned counsel for the informant.
2. The petitioners seek pre-arrest bail in connection with Dumariyaghat P.S. Case No. 30 of 2025 registered for the offence punishable under Sections 80, 103(1), 238 and 3(5) of the B.N.S.
3. Allegation is of committing murder of the daughter
Patna High Court CR. MISC. No.59804 of 2025(3) dt.19-09-2025 2/3 of the informant due to non-fulfillment of demand of dowry.
4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have falsely been implicated in the case. The petitioner no.1 is the father, petitioner no.2 is the brother and petitioner no.3 is the mother of the husband of the deceased. The husband of the deceased is already in custody since 08.04.2025. The petitioners have clean antecedent.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the nature of allegation against the petitioner no.3 Chanda Devi who is the mother-in-law of the deceased, I am not inclined to enlarge her on pre-arrest bail.
7. So far as the petitioner nos. 1 and 2 are concerned, the allegation being general and omnibus against them, they are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Dumariyaghat P.S. Case No. 30 of 2025, subject to the condition as laid down
Patna High Court CR. MISC. No.59804 of 2025(3) dt.19-09-2025 3/3 under Section 438(2) Cr.P.C / 482(2) BNSS.
8. The District Court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in Para-3 of the bail petition, this order will automatically lose its force.
9. The bail application stands disposed of.
