This application for anticipatory bail arises out of Kotwali P.S. Case N0. 279 of 2015, disclosing offences under Sections 379,411/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner has referred two orders passed by this Court dated 17.12.2015 and 05.02.2016 passed in Cr. Misc. No. 48763 of 2015 and Cr. Misc. No. 53005 of 2015, whereby similarly circumstanced co accused persons have been allowed anticipatory bail by this Court.
Considering aforesaid submission, after having gone through the copies of the said orders, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court
Patna High Court CR. MISC. No.55795 of 2019(2) dt.04-09-2019 2/2 below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kotwali P.S. Case No. 279 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
