The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

The prosecution case, in short, is that in the backdrop of a trivial issue, an altercation took place between the parties and in consequence thereof, all the accused persons assaulted the informant and her husband.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-06-2019. Charge sheet has already been submitted. All the accused persons are said to have assaulted the informant and her husband. According

Patna High Court CR. MISC. No.55921 of 2019(2) dt.03-09-2019 2/2 to Annexure-2, there is single lacerated would on the body of the informant. General and omnibus allegation has been made against the petitioner. No overt act is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Madhepura in connection with Shankarpur P.S. Case No. 88 of 2019.
