The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 413, 414 of the Indian Penal Code.

Two persons who were engaged in the business of buying and selling stolen motorcycles and spare parts were arrested by the police. The apprehended accused persons disclosed the name of the petitioner as their companion. The police seized one motorcycle from the house of the petitioner.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.70189 of 2021(3) dt.19-07-2022 2/2 petitioner that only on the confession of the accused persons the petitioner has been roped in the present case. The alleged seized motorcycle is not a stolen motorcycle and nobody claim or lodge any F.I.R for thef of the said motorcycle.

Considering the fact that one stolen motorcycle has been seized from the house of the petitioner and he has having criminal antecedents, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.

The petitioner may surrender before learned Court below and pray for regular bail.
