The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307, 504 of the Indian Penal Code. It is alleged that the informant made protest when the accused persons in order to capture the land of informant were keeping asbestos on the land adjacent to his house, then petitioners started to assaulting the informant, his sister and wife. When Harbal Rai came to pacify the matter then, he was also assaulted by Kamlesh Rai.
It is submitted by the learned counsel for the petitioners that injury has been found to be simple in nature. There is counter version of the occurrence.
Patna High Court Cr.Misc. No.14168 of 2015 (2) dt.06-04-2015 Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Baikunthpur P.S. Case No. 120 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
