JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 20-05-2015 Heard learned counsels for the petitioners and the State.

The petitioners are languishing in custody since 15.02.2015 in a case registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code.

Patna High Court Cr.Misc. No.15591 of 2015 (02) dt.20-05-2015 2/2 On information that the miscreants are preparing to commit dacoity, raid was laid, when from the possession of the petitioners Samsung mobiles with the sim cards of Aircel were recovered.

It is submitted by learned counsel for the petitioners that the seized mobiles are not stolen one and they have been purchased by the petitioners. A statement has been made in para 3 of Cr. Misc. No. 15591 of 2015 that the petitioner has no criminal antecedent whereas in para 3 of Cr. Misc. No. 16127 of 2015 statement has been made that the petitioner is accused in one other case. The investigation has already concluded. Considering the nature of recovery, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Bihiya P.S. Case No. 47 of 2015.
