The petitioner seeks bail in Simari (Dera OP) P.S. Case No. 193 of 2021, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, while the son of informant and other persons were returning home by Scorpio after attending funeral of grand-father of Ranjeet Singh, some miscreants attacked upon them, as a result of which son of informant died on the spot leading to registration of FIR against unknown.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of petitioner surfaced in this case on the basis of confessional statement of co-accused.

Patna High Court CR. MISC. No.70293 of 2021(3) dt.25-04-2022 2/2 Save and except confessional statement there is no material against him which shows his complicity in the alleged occurrence. Petitioner claims clean antecedent and he is in custody since 04.07.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Simari (Dera OP) P.S. Case No. 193 of 2021.
