The petitioner apprehends his arrest in Harlakhi P.S. Case No. 46 of 2013, registered for the offences punishable under Section 409 and other Sections of the Indian Penal Code. The petitioner is Panchayat Rojgar Sevak. The petitioner along with Mukhiya, Junior Engineer and others are alleged to have misappropriated Rs. 9,67,200/-, on the basis of the complaint petition the present FIR was lodged. Learned counsel for the petitioner submits that an enquiry was held and it was found that Rs. 59,184/- was only misappropriated. The petitioner has already deposited the entire amount. The Mukhiya Mahendra Ram of Gram Panchayat has already been enlarged on anticipatory bail vide order passed in Cr.

Patna High Court Cr.Misc. No.14329 of 2015 (2) dt.12-05-2015 2/2 Misc. No. 23542 of 2014.

Considering the facts aforesaid the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Harlakhi P.S. Case No. 46 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
