JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2021 Though, the present has been filed by way of second attempt at the behest of the petitioner for grant of anticipatory bail in connection with Minapur P.S. Case No. 467 of 2019 for the offence punishable under sections 30(a) (c), 41 of Bihar Prohibition of Excise Act, 2016 in as much as the earlier prayer of the petitioner for grant of anticipatory bail was disposed of by an order dated 05.12.2019 passed in Cr. Misc. No. 66388 of 2019, but the learned counsel for the petitioner has confined his relief to the extent that the time of four weeks granted to the petitioner to surrender before the learned court below be extended since the petitioner could not surrender within the said time frame on account of certain constraints. Considering the submissions made by the learned counsel for the petitioner as also taking into account the
Patna High Court CR. MISC. No.70132 of 2021(2) dt.22-12-2021 2/2 averments made in the present petition, I deem it fit and proper to grant two weeks' more time to the petitioner to surrender before the learned court below, however, rest of the order dated 5.12.2019, passed in Cr. Misc. No. 66388 of 2019 would stand as it is.
The present petition stands disposed of as not pressed, however, with the aforesaid liberty to the petitioner to surrender before the learned court of Spl. Judge, Excise Act, Muzaffarpur in connection with Minapur P.S. Case No. 467 of 2019 within a period of two weeks from today, in order to seek regular bail. (Mohit Kumar Shah, J) Tiwary/- U T
