JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of G.R. No. 5671/2014 in connection with Dagarua P.S. Case No. 307/2014, disclosing offences under Sections 302/34 of the Indian Penal Code.

Learned assisting counsel for the Public Prosecutor has failed to draw my attention to another material in the case diary on the basis of which it can be said that the petitioners were responsible for the death of the deceased.

Learned counsel appearing on behalf of the petitioners appears to be right in her submission that the petitioners have no criminal antecedent and there is no allegation against the petitioners nor any material collected so far in course of

Patna High Court Cr.Misc. No.14820 of 2015 (6) dt.13-08-2015 investigation to connect them with the offence under Section 302 of the I.P.C. It has further been submitted that the petitioners were granted interim protection by an order of this Court dated 25.06.2015 which they never misused.

In view of the above, it is directed that the petitioners shall remain on bail granted in the light of the order dated 25.06.2015.

Accordingly, this application is allowed.
