1. Heard the parties.

2. The present application has been filed for restoration of Cr. Misc. No. 30170 of 2023 which stood rejected on 28.06.2023 for non compliance of order dated 14.06.2023.

3. Learned counsel for the petitioner submits that opposite party no. 2 has appeared through her counsel by filing Vakalatnama on 17.05.2023 but due to inadvertence order regarding issuance of notice to the opposite party no. 2 has been typed in order dated 14.06.2023. Learned counsel further submits that on 25.08.2023 he came to know that Cr. Misc. No. 30170 of 2023 has been dismissed for non compliance of order dated 14.06.2023.
