The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 379/34 of the Indian Penal Code. The accusation is of making assault to the informant. The specific accusation of making assault with knife is against petitioner no.4 Ashok Yadav. It is also alleged that when parents of the informant came to rescue they were also assaulted and coaccused Ramesh Dubey took away mobile of the informant. It is submitted by learned counsel for the petitioners that one sharp cutting injury was found on the head of the informant though simple in nature and for other injuries opinion
Patna High Court Cr.Misc. No.14750 of 2015 (2) dt.13-04-2015 2/2 has been preserved.
In view of the above, let the learned Court below consider the prayer for regular bail of the petitioner no.4, if the petitioner surrenders within a period of six weeks. With the above observation, this application with respect to petitioner no.4 is, accordingly, disposed off. So far as petitioner nos. 1, 2 and 3 are concerned, considering the general and omnibus nature of accusation and injury has been found simple in nature, let they be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Guthani P.S. Case No.01 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
