12.07.2016 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in Bagaha Mahila P.S. Case No. 01 of 2014 registered under Section 376 of the Indian Penal Code pending before the Additional Chief Judicial Magistrate, Bagaha, West Champaran.

Considering that there is direct allegation against the Petitioner of having committed rape upon the lady, I am not inclined to grant bail to the Petitioner. The prayer for bail is rejected.

The concerned Magistrate is directed to commit the case to the Court of Sessions after which the Trial Court is directed to expedite the trial and conclude the same without granting unnecessary adjournment to any party for which reason he is directed to send a list of the

Patna High Court Cr.Misc. No.26411 of 2016 (3) dt.12-07-2016 witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the concerned Superintendent of Police, and the concerned Superintendent of Police is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
