The petitioner seeks bail in connection with Gaya Railway P.S.Case No. 55 of 2014 registered for the offences punishable under sections 379 and 411 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 26th September, 2014 passed in Cr.Misc. No. 34491 of 2014 with the following observations :- "Since the petitioner is in custody, the Special Railway Judicial Magistrate, Gaya is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within six months from the date of receipt/production of a copy of this order failing which the petitioner would be entitled to renew his prayer for bail."
Patna High Court Cr.Misc. No.15513 of 2015 (2) dt.15-04-2015 2/2 It has been contended that though the petitioner is in custody since 5th June, 2014, but till date not a single witness has been examined on behalf of the prosecution in the trial before the Magistrate.
Regard being had to the observations made in the aforesaid order dated 26th September, 2014 passed in Cr. Misc. No. 34491 of 2014, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Gaya in connection with Gaya Railway P.S.Case No. 55 of 2014.
