The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that petitioner and the victim are neighbours as the matrimonial home of the petitioner is adjacent to the parental home of the victim, it is next submitted that it absolutely does not stand to reason that when the petitioner and the victim are known to each other then why the petitioner would indulge in such an act, it is next

Patna High Court CR. MISC. No.70557 of 2021(2) dt.28-07-2022 2/2 submitted that the victim is mother of five children and is known to the petitioner, it is next submitted that petitioner now is 35 years of age and till 35 years has remained a person with clean antecedent and all of a sudden has been implicated in the present case.

Learned counsel for the petitioner after arguing vehemently seeks permission to withdraw the present anticipatory bail application.

Permission is accorded.

In the event, if the petitioner surrenders in the learned court below by 18.08.2022, the learned court below shall try to dispose of the case on the same day, if possible, as petitioner is a person with clean antecedent.
