JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-12-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Chiraiya Police Station Case No. 231 of 2016, disclosing offences under Sections 420 and 406 of the Indian Penal Code.
On the basis of the written report of the Junior Engineer, the First Information Report has been registered with the allegation that the petitioner has collected illegal money from B.P.L. families in the name of electrification at the rate of Rs. 300/- each.
It is submitted on behalf of the petitioner that no basis has been mentioned in the First Information Report for implicating the petitioner as an accused. It has also been

Considering the above submission, this application is allowed.
Let the petitioner, Jitendra Prasad Yadav @ Jeetendra Pd. Yadav, in the event of his arrest or surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sikrahana at Dhaka, East Champaran, in connection with Chiraiya Police Station Case No. 231 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
