JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-01-2019 Learned counsel for the petitioner seeks permission to withdraw the application with respect to petitioner no. 1 as he has already surrendered to the process of law. The application with respect to petitioner no. 1 is dismissed as having become infructuous.
Heard the learned counsel for the petitioners and the State.
The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Jamo Bazar P. S. Case No. 176 of 2018 dated 30.10.2018 instituted for the offences under Sections 323, 504, 506, 354, 379 and 34 of the Indian
Patna High Court Cr.Misc. No.3332 of 2019(2) dt.24-01-2019 2/2 Penal Code.
There is a counter version of the occurrence and the present case has been lodged after two days of the reported occurrence.
In view of the nature of accusation against the petitioner no. 2, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - XIII, Siwan in connection with Jamo Bazar P. S. Case No. 176 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
