JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-02-2019 The grievance of the petitioner is that even though he has completed the work in question, and has submitted his bills for payment of the remaining dues, the respondent authorities are not considering the same. Learned counsel has referred the statements made in Paragraph 9, 10 and 11 of the writ application to show that despite repeated persuasion by the petitioner the authorities concerned particularly the Executive Engineer (Respondent No. 3) has not taken any decision and is sitting over the claim for more than one year. Learned counsel for the State is present.

In the facts and circumstances of the case, without going

Patna High Court CWJC No.1826 of 2019(2) dt.19-02-2019 2/2 into the merit of the claim of the petitioner, this Court is willing to direct the Executive Engineer, Building Division, Ara (Respondent no. 3) to look into the grievance of the petitioner, consider his request as contained in applications dated 17.07.2018 and 26.07.2018 contained in Annexures 4 and 5 to the writ application.

In case the claim of the petitioner is found genuine and correct, steps must be taken to pay the genuine claim of the petitioner within a period of three months from the date of receipt/production of a copy of this order. If the claim as a whole or any part thereof is not found payable, the Executive Engineer (Respondent No. 3) shall communicate the petitioner the reasoned order showing as to why the claims have been refused.
