The petitioner has preferred this application for grant of regular bail in a case registered under sections 392 and 411 of the Indian Penal Code.

As per the prosecution case, the three accused persons surrounded the informant and looted his scooty. On hulla being raised, the accused persons who were making an attempt to escape were caught. The petitioner was amongst them. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under a misunderstanding. He was not involved in the occurrence. He is in custody since 7.8.2021 and has no criminal antecedent.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner having remained in custody for about 10 months and having no criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Nayagaon P.S. Case no. 138 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra.
