1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 387, 504, 506 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioners have antecedent of one case and petitioner nos. 1 and 4 are women and the informant alleges that on 14.08.2023, he was constructing his boundary wall, when

Patna High Court CR. MISC. No.63925 of 2024(2) dt.11-09-2024 2/3 accused persons came and assaulted him and Kanhaiya took Rs. 10,000/- from his pocket.

Learned counsel for the petitioners submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the occurrence took place on account of dispute relating to land. It is also submitted that there is no specific allegation of assault against any of the accused persons and petitioners and the informant are agnates, it is also submitted that a proceeding under Section 144 Cr.P.C. was initiated in which the rule was made absolute against the informant and vacated in favour of the petitioners as would manifest from Annexure-2 to the anticipatory bail application.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with

7. Accordingly, the instant anticipatory bail application stands allowed.
