The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 308, 341, 147 and 149 of the Indian Penal Code. It is alleged that the informant went to village Kusmaha, Laxmipur to purchase Bullock cart and stayed in the house of Vijay Yadav. All of sudden he woke up and learnt that all the accused persons assaulted the informant.

It is submitted by the learned counsel for the petitioners that the informant was caught with arms on

Patna High Court Cr.Misc. No.14383 of 2015 (2) dt.07-04-2015 02.06.2014 and is handed over to the police and Kharagpur (Gangta) P.S. Case No. 136 of 2014 was registered under Sections 341, 323, 426, 447 and 25(1B)a, 26, 35 of the Arms Act and thereafter the informant in connivance of police get the present case registered to save his own skin.

Considering the fact that the petitioners' side case is also at the earlier point of time, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur (Gangta) P.S. Case No. 137 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
