The petitioner is apprehending his arrest in connection with Complaint Case No.641 of 2016 , registered for offences punishable under Section 498-A of the Indian Penal Code and Section 4 of the D.P. Act.

Allegation against the petitioner is of assaulting the informant with respect to demand of dowry and she was pregnant but still she was assaulted and ousted from the house. Submission of the learned counsel for the petitioner is that he is ready to keep O.P.no.2 with dignity and care and provide all the facilities to her if she co-operates. Patna High Court CR. MISC. No.2981 of 2019(4) dt.17-04-2019 2/2 O.P.no.2 also, who has submitted that the O.P.no.2 is ready to reside with the petitioner, if she is allowed to live with all dignity and care and all the facilities including the medical facilities will be provided to her. .

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below on 01.05.2019 and on that day, O.P.no.2 shall also remain present and on filing a petition by the petitioner that he is ready to keep her and ready to take her from the court itself and to provide all the facilities including the medical facilities, the learned court shall release the petitioner on provisional bail for a period of six months in connection with Complaint Case No.641 of 2016 and during that period, he will watch the conduct of both the parties along with their marital relationship and once being satisfied with marital relationship and conduct of both the parties, he will either confirm the bail bond of the petitioner or cancel the same. With the aforesaid observation, this application is disposed of.
