Patna High Court Cr.Misc. No.26740 of 2014 (3) dt.12-01-2015 2/3 Dumariyaghat P.S.Case No. 07 of 2014 registered under Sections 386,387/34 of the Indian Penal Code and 17 C.L.A Act and accordingly all the above stated petitions are being disposed of by this common order.
Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner in Cr. Misc. No. 26740 of 2014 and petitioner in Cr. Misc. No. 28940 of 2014 are not named in the first information report whereas, petitioner in Cr. Misc. No.30199 of 2014 is named in the first information report. During course of investigation, petitioner in Cr. Misc. No. 28940 of 2014 was arrested and Sims which had been used in demanding the extortion money were recovered from his possession. So far as, petitioner in Cr. Misc. No. 26740 of 2014 is concerned, nothing has been recovered from his conscious possession and except the confessional statement, there is nothing against him. Similarly, petitioner in Cr. Misc. No. 30199 of 2014 though named in the first information report but except the averment made in first information report there appears to be nothing against him.
Accordingly, petitioner in Cr. Misc. no. 26740 of 2014 and petitioner in Cr. Misc. No. 30199 of 2014 are directed to be
Patna High Court Cr.Misc. No.26740 of 2014 (3) dt.12-01-2015 3/3 released on bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Dumariyaghat P.S.Case No. 07 of 2014.
So far as prayer for bail of the petitioner in Cr. Misc. No. 28940 of 2014, namely, Dasarath Ram @ Munna is concerned, the same stands rejected.
