The petitioners seek pre-arrest bail in connection with Narari Kala Khurd P.S. Case No.37 of 2018 registered for the offences punishable under Sections 341, 323, 504, 324 and 308 read with 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioners that co-accused Ranjit Singh @ Ranjit Kumar and Dharmendra Kumar against whom there is more serious allegation than the petitioners no.2 and 4 have already been granted pre-arrest bail by a Bench of this Court vide order dated 22.01.2019 passed in Cr. Misc. No.2843 of 2019. It is further

Patna High Court Cr.Misc. No.3565 of 2019(2) dt.25-01-2019 2/2 contended that as far as petitioner no.1 Ram Janam Singh @ Ram Jan Singh and petitioner no.3 Janeshwar Singh are concerned, they have already been arrested by the police. In view of the submission made above, the application for grant of pre-arrest bail to the petitioner no.1 Ram Janam Singh @ Ram Jan Singh and petitioner no.3 Janeshwar Singh is dismissed as infructuous.

As far as petitioner no.2 Malti Devi and petitioner no.4, Manish Kumar are concerned, in the event of arrest or surrender in the court below, they directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Narari Kala Khurd P.S. Case No.37 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
