The petitioner seeks bail in connection with Laheri P.S. Case No. 112 of 2016 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 24.08.2021, charge-sheet has been submitted in the case and has antecedent of nine cases, it is further submitted that out of nine cases the petitioner stands acquitted in seven cases as such presently there are only two cases pending against the petitioner in which he is on bail. The learned counsel submits that the informant alleges that in the

Patna High Court CR. MISC. No.70561 of 2021(2) dt.27-04-2022 2/3 night of 19.04.2016 some unknown thieves entered his house after breaking the lock and committed theft of jwellery and cash as detailed in the FIR.

The learned counsel submits that petitioner has been falsely implicated in the present case because of his antecedent and draws attention of the court to the impugned order and submits that main consideration for rejecting the bail application of the petitioner was that he has antecedents. It is submitted that no doubt, the petitioner had antecedent of nine cases but then he was acquitted in seven cases that amply demonstrates that he was implicated falsely in all those cases.

The learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that petitioner is in custody since 24.08.2021, charge sheet has been submitted in the case and no incriminating article was recovered from his possession as submitted, by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Laheri P.S. Case No. 112 of 2016, with a
