2. The petitioner has preferred this application for grant of regular bail in connection with Nawada (Nagar) P.S. Case No. 519 of 2016, dated 11.09.2016, registered for the offence punishable under Section 395 of the Indian Penal Code.

3. As per the prosecution case, on 10.06.2016 the informant along with driver was going to Ranchi on a truck bearing reg. no. JH02AF-0384 which was loaded with 1080 packets of biscuits. At about 02:00 AM, near Budhaul bus stand, a light blue Bolero intercepted the truck and the occupants of the said Bolero forcibly took the owner and driver of the truck to an

Patna High Court CR. MISC. No.59766 of 2025(2) dt.01-09-2025 2/3 unknown location and their mobile phones, Rs. 7,000/- cash along with the 1080 loaded biscuits. The driver and the owner were later released.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. and the name of the petitioner has sprung up in the confessional statement of the co-accused Vinod Giri. No incriminating article has been recovered from the conscious possession of the petitioner. The co-accused person, on whose confessional statement the name of the petitioner transpired in the present case, has already been granted bail by a co-ordinate Bench vide order dated 11.12.2024 passed in Cr. Misc. No. 57109 of 2024. Another co-accused person namely, Pintu Kumar has been granted bail by a coordinate Bench of this Court vide order dated 01.02.2024 passed in Cr. Misc. No. 3783 of 2024. The petitioner carries three criminal antecedents as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 25.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and

No.59766 of 2025(2) dt.01-09-2025 3/3 circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada (Nagar) P.S. Case No. 519 of 2016, on further condition:

(i) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
