ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.07.2019 in connection with Siwan Town P.S. Case No.406 of 2019 registered for the offence under Section 414 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries of 7 litres 200 ML. of foreign liquor were not from the conscious possession of the petitioner, but from the motorcycle.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with
