1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Udwant Nagar P.S. Case No. 359 of 2022 dated 03.08.2022 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. This is second attempt of the petitioner for the relief of regular bail after his earlier attempt for the same relief was rejected by this court vide order dated 28.02.2023 passed in Cr. Misc. No. 64791 of 2022.

4. The main submissions advanced by learned counsel for the petitioner are that the petitioner is a young person, having fair and clean antecedent and he has been languishing in

Patna High Court CR. MISC. No.60582 of 2023(3) dt.06-10-2023 2/2 jail since 28.08.2022 and the other co-accused person has been granted bail by this court and trial of the petitioner has started and upon him the charges have been framed on 23.09.2023.

5. Learned APP appearing for the State has opposed the bail prayer.

6. Considering the above submissions and mainly petitioner's custody period and his young age as well as his fair antecedent and also the initial stage of his trail, in my opinion, in the said circumstances, the petitioner now deserves to the privilege of bail. Accordingly, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Udwant Nagar P.S. Case No. 359 of 2022.
