2. The petitioner is apprehending his arrest in connection with Patrakar Nagar P.S. Case No. 35/2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 223 of the B.N.S. and 25(9) of the Arms Act.
3. As per prosecution case, the officer in-charge, Patrakar Nagar Police Station saw a video on social media at 10:15 AM on 28.01.2025 one boy was seen for making a fire. During course of investigation, the officer in-charge/informant found that a group of 15-20 boys led a procession and one of them was alleged to have celebratory gunfire on the eve of 26.01.2025.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.60643 of 2025(2) dt.10-09-2025 2/3 petitioner is innocent and has committed no offence as alleged in the FIR. The petitioner bears no criminal antecedent. The name of petitioner has been surfaced in this case during course of investigation in para 13 of the case diary and co-accused Ankit Kumar who is said to have sold the motorcycle bearing Registration No. BR01DZ0457 to the present petitioner. Except confessional statement of co-accused, there is nothing on record to demonstrate the complicity of the present petitioner with the alleged occurrence. The petitioner has nothing to do with the alleged occurrence. He orally submits that the petitioner will not abscond rather will cooperate in the investigation to prove his innocence.
5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioner and submits that participation in the alleged occurrence of the petitioner cannot be ruled out.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be

No.60643 of 2025(2) dt.10-09-2025 3/3 released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna (Sadar) in connection with Patrakar Nagar P.S. Case No. 35/2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.
7. The application stands allowed.
8. However, it is made clear that if the Investigating Officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this Court are not co-operating in the investigation, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
