JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 20.09.2014 in connection with Tarapur P.S. Case No. 107 of 2014 for the offences instituted under Sections 147, 148, 149, 341, 324, 307, 120(B) of the I.P.C. and Section 27 of the Arms Act. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on 19.09.2014, the informant, namely, Ashwani Kumar @ Munna went out from home for going to School at 8.30 A.M. and when reached between Kayargama and Shantinagar Bridge then he saw five persons were sitting in that he knows to three persons by name (1) Tatav Yadav
(2) Mithun Devraj and two were unknown seeking him can identify. After that three of them was started to chase. Devraj was

Tatav Yadav and Mithun fired from pistol first hit at the back and other hit at the right elbow. He fell down and cried save me -2 people was working in the filed chased miscreants and sought two persons and his motorcycle was also left there bearing No. BR 10H/7179.
It has been submitted on behalf of the petitioner that there is no allegation of causing any injury to the informant by the petitioner. Further it has been submitted that the petitioner has got no criminal antecedent and he is in custody since 20.09.2014. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Adhoc Additional Sessions Judge-VIII, Munger, in connection with Sessions Case No. 952 of 2014, arising out of Tarapur P.S. Case No. 107 of 2014.
