Mr.Akbar Ali ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Pakribarawan P.S. Case No.205 of 2016 registered under Sections 147, 148, 149, 323, 341, 307, 353, 379, 427 and 504 of the Indian Penal Code.

The accusation is that on 28.10.2016, 50 persons, named in the F.I.R., along with 100-150 unknown came with two dead persons at the Primary Health Centre, Pakribarawan, where the informant was posted as Medical Officer and started to give pressure upon him to get them treated. When the informant refused to get them treated, all started to cause assault him and damaged the articles of the Primary Health Centre.

The name of the petitioner surfaced, in course of investigation without any specfic overt act. Further submission is that the co-accused Md. Taufik, who is named in the F.I.R., has already been granted the privilege of pre-arrest bail by a Bench of this Court vide order dated 04.04.2019 passed in Criminal Misc. No.7216 of 2019. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, Nawada, in connection with Pakribarawan P.S. Case No.205 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
