The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/325/384/120A/504/34 of the Indian Penal Code. It is alleged that the co-accused Udho Singh and Amazad Khan along with unknown entered into the factory of the informant, brutally assaulted the informant, causing fracture injury and his two teeth were uprooted and demanded extortion of Rs.10,000/- per month. The petitioner's hand in the occurrence is also suspected.

It is submitted by learned counsel for the petitioner that there is no overt act alleged against the petitioner but the anticipatory bail application of the petitioner was rejected by the

Patna High Court Cr.Misc. No.15073 of 2015 (2) dt.13-05-2015 2/2 learned Sessions Judge, Gopalganj since the petitioner has serious criminal antecedent.

Considering the fact that no overt act is alleged against the petitioner, it is a fit case for consideration of regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Mirganj P.S. Case No. 16 of 2014, pending before the learned Chief Judicial Magistrate, Gopalganj.

With the above observation, this application is, accordingly, disposed off.
