The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act.
Considering the fact allegation against petitioner no. 2 Birendra Kumar to have caused firearm injury, I am not inclined to enlarge him on anticipatory bail only for the reason that the Doctor has found simple firearm injury. Hence, petitioner no. 2 Birendra Kumar may surrender before the court below and pray for regular bail. Allegation against petitioner no. 1 Ranjeet Kumar @ Ranjeet Singh and others is of commission of assault with
Patna High Court Cr.Misc. No.3994 of 2019(2) dt.25-01-2019 2/2 lathi. Allegation is general and omnibus.
Let the petitioner no. 1 Ranjeet Kumar @ Ranjeet Singh, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Sandesh Police Station Case No. 105 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner no. 1 shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner no. 1.
