JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioner apprehends her arrest in relation to Complaint Case No. 618 of 2013 registered under Sections 417, 406 and 504 of the Indian Penal Code.
This Court is surprised as to the case and conduct of the learned Incharge Special Judge, Rohtas in not entertaining the application. The allegation is that the complainant had paid the petitioner and her husband a sum of Rs. 1,50,000/- to get a job in Saudi Arab in Super Market. When he reached Saudi Arab, instead of getting a job in Super Market, he was asked to look after she-goats. What is curious is that the complainant did give up his job in Saudi Arab and returned to India. It is only when he came after some time to India that he lodged this case, which, on
Patna High Court Cr.Misc. No.18282 of 2015 (2) dt.11-06-2015 2/2 the face of it, is unsustainable. However, the friends of the complainant, who had gone to Saudi Arab, did not return to India. Be that as it may, in the event of her arrest/surrender before the court below within four weeks from today, let the petitioner, namely, Aasama Khatoon be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class-cum-Additional Munsif-IV, Bikramganj, Rohtas/Incharge Court in connection with Complaint Case No. 618 of 2013, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
