JUSTICE GOPAL PRASAD ORAL ORDER 16-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 417 and 420 of the Indian Penal Code.

The allegation against the petitioner is that the money which was taken for debt was returned by a cheque, but the said cheque was not accepted and was returned.

Learned counsel for the petitioner submits that the petitioner is ready to pay the amount for which the cheque was issued. However, he prays for three months time to pay the money

Patna High Court Cr.Misc. No.24001 of 2016 (2) dt.16-06-2016 2/2 to the complainant.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on provisional bail for three months in the event of arrest of surrender before the learned Court below within a period of four weeks from the date of receipt of the order on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, J.M. 1st Class, at Muzaffarpur in connection with Complaint Case No. 227 of 2015 (Trial No. 227 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Further with condition that petitioner will pay the money to the complainant either in Court or in any of the Bank Account of the complainant and if the said amount is paid within time, mentioned above i.e. three months then the Court below itself confirm the bail bond of the petitioner. However, if the amount will not be paid to the complainant within time, the bail bond of the petitioner stands cancelled.
