2. The petitioner seeks regular bail in connection with Raghunathpur P.S. Case No. 139 of 2025 for the offences registered under Sections 30(a), 41(1) and 52 of the Bihar Prohibition & Excise Act.

3. There is recovery of 34 litre country made liquor from the bush behind the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner rather recovery has been made from the bush. Petitioner was not arrested on the spot. Petitioner has no concern with the seized liquor. Petitioner has no criminal antecedent. He is in

Patna High Court CR. MISC. No.58228 of 2025(2) dt.10-09-2025 2/2 judicial custody since 29.06.2025.

5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Exclusive Special Excise Court No. 1, East Champaran at Motihari in connection with Raghunathpur P.S. Case No. 139 of 2025.
