Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and 27 of Arms Act.
Submission is that the FIR named accused person have already been granted anticipatory bail by this Court vide Annexure-2. Petitioner is not named in the FIR. Learned counsel for the informant opposed the prayer for bail on the ground that name of the petitioner surfaced on the report of the spy and thereafter confessional statement of the petitioner is there while in police custody, wherein the petitioner has admitted his guilt. No.5488 of 2019(4) dt.19-04-2019 2/2 police while in police custody is irrelevant and there is no other material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pipra Kothi Police Station Case No.110 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
