The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 379, 506, 34 of the Indian Penal Code.

Allegedly, the petitioners along with other co-accused persons abused and assaulted the informant and her husband. They assaulted them with lathi, danda. Petitioner no.2 is said to have snatched golden chain from her neck and Rs. 50,000/- from the pocket of her husband.

It is submitted by learned counsel for the petitioners that they are quite innocent and have not committed any offence as alleged in

Patna High Court CR. MISC. No.58755 of 2022(2) dt.03-01-2023 2/2 the aforesaid FIR. They have been falsely implicated in this case. The entire allegations are false and concocted. No occurrence as alleged took place. The informant and the petitioners are agnates. There is general and omnibus allegation against the petitioners while specific allegation of assault with sharp knife to Ram Pravesh Rai is upon Sarvesh Kumar @ Methu Kumar. But as per the injury report of Ram Pravesh Rai, injury is simple in nature. Petitioner nos. 1 to 3 have one criminal antecedent whereas petitioner no.4 has no criminal antecedent as mentioned in para-3 of this application. Learned APP for the State opposed the prayer for bail.

Having regard to the facts and circumstances of the case, since there is general and omnibus allegation against the petitioners, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Vaishali P.S. Case No.

(2) of the Cr.P.C.
