JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 19.01.2015 in connection with Kudra P.S. Case No. 196 of 2014 for the offences instituted under sections 304-B, 328/34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the daughter of the informant was married with one Dhanajaya Yadav. It is alleged that on 24.10.2014 he was informed that her daughter has been poisoned and she has been admitted in a hospital. When he reached there, he was informed that his daughter has died and her dead body has been taken to the bank of river for funeral rites. It is submitted on behalf of the petitioner that the petitioner is the father-in-law of the deceased and that the petitioner is separate in mess and property. It is further pointed out that the petitioner has got no criminal antecedent and he is in custody since 19.01.2015.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Kudra P. S. Case No. 196 of 2014.
