2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32(i)(ii), 36, 41(i) of the Bihar Prohibition and Excise Act.

3. On a secret information, a truck was intercepted and on search of the said truck, 2323.36 liters of foreign liquor has been recovered.

4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the said truck and has been made accused in this case only on suspicion. Petitioner claims clean antecedent.

5. Considering the facts aforesaid and the fact that no recovery has been made from possession of petitioner and he has got clean antecedent, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks

Patna High Court CR. MISC. No.61496 of 2023(2) dt.16-10-2023 2/2 from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise No. 1 cum A.D.J. IV, Kaimur at Bhabua in connection with Mohania P.S. Case No. 283 of 2022, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
