In the instant petition, petitioner has prayed for issuance of a direction to the respondents to pay the compensation to the petitioner treating the nature of the acquired land of the petitioner bearing portion of Plot No.1233, Khata No.45 of Village Gandaul under Mahisi Anchal of the District of Saharsa as residential.

3. Learned counsel for the petitioner submits that this case may be disposed of with liberty to the petitioner to file fresh representation before the District Magistrate cum Collector, Saharsa, respondent no.2 for redressal of his grievances.

In view of the submissions of learned counsel for the parties, the present writ petition stands disposed of with liberty to the petitioner to file fresh representation before the respondent no.2, District Magistrate cum Collector, Saharsa for redressal of his grievances within six weeks from today.
