The petitioners are languishing in custody since 15.10.2014 and 16.01.2015 respectively in a case registered for the offences punishable under Sections 147, 148, 149, 427,

Patna High Court Cr.Misc. No.15618 of 2015 (02) dt.20-05-2015 2/3 436, 120B, 121 of the Indian Penal Code, 3/4 of Explosive Substances Act and 16, 17, 18, 19, 20, 21, 22 of Unlawful Activities Prevention Act.

It is alleged that the police received secret information that 78 hard core Naxal are operational in the area, raid was laid, when it was found that more than 100 to 150 extremists have exploded community building near village Parsimore by making nine blasts, the police reached at the place of occurrence and from the night guard it was found that 100 to 150 Naxal came with 25 Kane bombs and they tried to explode the building. On the information suggested by the night guard and others the petitioners were named in the First Information Report. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. Statement has been made in para 3 of both the petitions that the petitioners have no criminal antecedent and co-accused Poulush Hembram @ Prithvi Raj Hembram has been granted anticipatory bail by a Coordinate Bench of this Court vide Cr. Misc. No. 18419 of 2014. It is submitted by learned counsel for the petitioners that the name of petitioner Chandrika Pujhar has wrongly been mentioned in the First Information Report as Chandrika Judpania.

No.15618 of 2015 (02) dt.20-05-2015 3/3 Considering the aforesaid facts, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with U.A.P. Case No. 11 of 2015 arising out of Khaira P.S. Case No. 168 of 2013.
