JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father in law of the complainant and is languishing in jail custody since 15.03.2016 in connection with Complaint Case No. 31C of 2001 in which prima facie case for the offences punishable under Sections 498A, 406 of the Indian Penal Code and Section 3⁄4 of D.P. Act was found. The present complaint case was filed in the year 2001 and processes were issued against the petitioner in the same year. The petitioner filed anticipatory bail petition in the year 2002 which was rejected but even then he did not choose to appear before the court below as a result whereof, he was declared absconder on 24.12.2004.

Considering the previous conduct of the petitioner as

No.25690 of 2016 (2) dt.22-06-2016 2/2 well as this aspect of the matter that due to this petitioner the trial delayed for a long period, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Complaint Case No. 31C of 2001 pending in the court of Sub Divisional Judicial Magistrate, Jamui stands rejected.
