JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2022 In compliance of the order of this Court, disobedience whereof has been complained of, the contemner University has filed a show cause in which it has taken a stand that a sum of Rs. 18,26,820/- has been found payable towards the differential amount of arrears of salary for the period 16.05.2009 to August, 2017, whereafter request had been sent to the State Government several times for release of grant for making payment to the

Patna High Court MJC No.3368 of 2019(6) dt.06-07-2022 2/2 petitioner herein, however, till date the Government has not diverted any fund for the purposes of making payment to the petitioner and others.

Having regard to the aforesaid stand taken by the University, I deem it fit and proper to dispose off the present contempt petition with liberty to the petitioner to approach the Chief Secretary, Government of Bihar, Patna for redressal of his grievances. It is needless to state that the petitioner would be at liberty to file a fresh writ petition in case his grievances/claim stand unredressed.

This order is being passed in the peculiar facts and circumstances of the case since the State Government was neither a party in the writ petition nor in the present contempt petition, hence the State Government cannot be hauled up for contempt at this stage and in the present proceedings.
