JUSTICE SANDEEP KUMAR ORAL ORDER 24-03-2025 This is an application for quashing the cognizance order dated 29.05.2018 passed by the learned Sub-Divisional Judicial Magistrate, Purnea by which the Court below has taken cognizance under Section 498A of the IPC in Complain Case No. CA 334/2017.

2. As per the prosecution case, the accused persons demand dowry from the complainant and due to non-fulfillment of demand of dowry, they tortured her and ousted her from her matrimonial house.

3. From the reading of the complaint as well as from the reading of the impugned order, offence under Section 498A of the IPC is made out against the petitioner and the Court

Patna High Court CR. MISC. No.2859 of 2019(2) dt.24-03-2025 2/2 below has rightly taken the cognizance under Section 498A of the Indian Penal Code.

4. I do not find any illegality in the impugned order and therefore this application is dismissed.

5. If the Complaint Case No. C A 334/2017 is still pending before the Sub-Divisional Judicial Magistrate, Purnea, he will disposed off the same within six months and he send a compliance report to this Court.
