2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 190, 191(2), 126(2), 115(2), 118(2), 109, 351(2) and 352 of the B.N.S..
3. As per prosecution case, on 11.02.2025 at about 6 PM, when the informant and his friend were going to Imli Chowk to eat biryani and reached near the graveyard, this petitioner, along with four to five unknown persons, assaulted informant and his friend with fist, kicks, belt and sharp edged weapon due to which both of them sustained injuries.
4. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.59739 of 2025(2) dt.03-09-2025 2/3 behalf of the petitioner that petitioner is quite innocent and has committed no offence. For the same set of occurrence, three different F.I.Rs. have been lodged bearing Bettiah Town P.S. Case No. 57 of 2025 which has been lodged by the police, Bettiah Town P.S. Case No. 58 of 2025 which has been lodged by this petitioner against informnat and others and the present case, i.e. Bettiah Town P.S. Case No. 59 of 2025 which has been lodged by the informant. Allegation of assault is general and omnibus and no specific accusation of overt act has been alleged against this petitioner. It is further submitted that one loaded pistol was recovered from possession of father of informant, namely Sikandar Kumar.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and case and counter-case between the parties, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs.
Patna High Court CR. MISC. No.59739 of 2025(2) dt.03-09-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 59 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S..
